Terms and Conditions

1. GENERAL PROVISIONS

The terms used in the Regulations below are defined as follows:

• House - a recreational property offered for rent and presented on the website www.lesnewzgorze7.pl, located in the municipality of Ustka, ul. Leśne Wzgórze 7, 76-270 Machowino.

• Host - the entity offering rental services, managing and servicing the House, as well as individuals acting on behalf of and for the Host.

• Leśne Wzgórze Area - the plot area with facilities intended for use by Clients and Guests.

• Client - a person who has made a valid and confirmed reservation for the House.

• Guest - a person entitled to use the House and the Area, regardless of whether it is the Client or another person authorized by the Client.

• The Host provides Guests with the House under the conditions described in the Regulations.

• Making a reservation implies acceptance of the terms of the Regulations.

• The Host reserves the right to change the regulations.

2. BOOKING

• Booking can be made by email, phone, or through booking services.

• To reserve a stay at Leśne Wzgórze, a prior booking is required, accompanied by a 50% deposit of the stay's price, along with the settlement of the remaining amount agreed upon during the reservation.

• The remaining part of the booking fee is payable by bank transfer no later than 3 days before the arrival date or in cash on the day of arrival.

• In the case of reservations made less than 3 days before the start of the stay, the total payment for the stay must be made at the time of booking.

• Failure to pay the deposit or the entire amount results in the cancellation of the reservation.

• In the event of cancellation more than 30 days before the planned arrival, the amount paid for the reservation is fully refundable.

• In the event of cancellation between 30 and 7 days before the planned arrival, 50% of the paid amount for the reservation is refundable.

• In the event of cancellation less than 7 days before the planned arrival, the paid amount for the reservation is non-refundable.

• In the event of canceling the stay during its realization, no refunds are provided.

• Any changes to the arrival or departure date (e.g., late arrival or early departure, cancellation of the stay) do not entitle to a reduction in the cost of the stay and a refund of any funds.

3. CHECK-IN AND CHECK-OUT

• The Leśne Wzgórze House is rented on a daily basis. The minimum reservation length is 5 days.

• Check-in starts at 3:00 pm, and check-out is at 10:00 am.

• The exact date and time of the Guest's arrival at Leśne Wzgórze should be confirmed by phone or email no later than the day before arrival.

4. VISITS OF UNREGISTERED GUESTS

• Visits and staying in the Leśne Wzgórze Area by unregistered guests require prior approval from the owner.

• The Guest of Leśne Wzgórze is fully responsible for any irregularities or issues arising from these visits.

• The Host has the right to enter the rented House without the Guests' permission in case of noticing a threat to the safety of the Guests or property, behavior that could significantly worsen the condition of the House, or other situations inconsistent with the principles of social coexistence. The Host reserves the right to expel Guests from the House.

• The number of people to stay in the House is limited to the number specified in the reservation process. If the number of people turns out to be greater than stated in the reservation, the Host of Leśne Wzgórze reserves the right to terminate the lease agreement.

5. CIGARETTES, TOBACCO, AND OTHER SUBSTANCES

• Smoking cigarettes (including electronic cigarettes), tobacco, and other substances is strictly prohibited in the House.

6. DAMAGES

• In the event of damages caused by the Guest, they will be charged the full cost of restoring the property to its condition before the damages occurred.

• The Guest should report any deficiencies or defects in the rented House on the day of arrival.

• Failure to report comments and reservations (in writing) regarding the technical condition on the day of check-in is equivalent to the House, its surroundings, and the equipment contained in it being deemed fit for use without comments and reservations by the Guest.

• Any defects arising during the stay should be reported promptly to the Host of Leśne Wzgórze.

• The Guest is obligated to repair or reimburse the cost of damaged equipment, its replacement, or repair.

• In case of losing the key, a fee of 200 PLN is charged.

• In case of losing or damaging the gate remote control, a fee of 200 PLN is charged.

• In case of losing or damaging the blinds remote control, a fee of 200 PLN is charged.

7. RUBBISH

• All household waste should be placed only in the containers located in designated areas on the property.

8. PETS

• The issue of pets' stay in Leśne Wzgórze is subject to agreement with the Host.

9. OTHER

• Leśne Wzgórze is not responsible for inconveniences such as power or water supply interruptions, or lack of TV or Wifi signal, etc.

• Leśne Wzgórze is not responsible for valuable items and money left behind; therefore, due care should be taken when closing windows and doors when leaving the house.

• Leśne Wzgórze reserves the right, in case of sudden malfunctions or other random events, to shorten the reservation and refund the unused accommodation costs.

• The Guest is obliged to comply with the rules of good neighborliness, maintain cleanliness in the House and its surroundings, and keep the rented House in proper condition. In case of leaving an extraordinarily messy or dirty House, Leśne Wzgórze has the right to charge the Guest an additional cleaning fee of 500 PLN.

• If, due to the Guests' disturbance of the order, the Host of Leśne Wzgórze is called to the property or the Municipal Guard or the Police are called to intervene, Leśne Wzgórze will be entitled to immediately terminate the agreement due to the Guest's fault and simultaneously has the right to charge the Guest a contractual penalty of 1000 PLN.

• Unregulated matters in Terms and Conditions are subject to the provisions of the Civil Code.

• The court competent to resolve all disputes is the court in Słupsk.

10. DATA PROTECTION

• In accordance with Article 13 of the General Data Protection Regulation of April 27, 2016 (EU Official Journal L 119 of May 4, 2016), the Host informs that:

• The Administrator of your personal data is the Host, i.e., Andrzej Drwięga.

• Your personal data will be processed for the purpose of fulfilling the contract. The legal basis for processing this data is Article 6(1)(b) of the GDPR.

• Recipients of your personal data will only be entities authorized to obtain personal data under the law and additional service providers for whom we mediate in booking.

• Your personal data will be stored for a period of 1 year.

• You have the right to request access to personal data, their correction, deletion, or restriction of processing, objection to data processing, data transfer, and the right to withdraw consent.

• You have the right to lodge a complaint with the supervisory authority.

• Providing personal data is a condition for concluding the contract / failure to provide it may result in the refusal to provide services.

IN ADDITION, THE HOST INFORMS THAT:

• Surveillance cameras have been installed on the House premises.

• Cameras are installed only outside the House; the interior is not subject to monitoring.

• The content of the surveillance is automatically recorded and is not the subject of current observation.

• The sole purpose of video surveillance is to protect property, and assets, and increase the safety of Guests and the Host.

• The storage period for personal data from monitoring is a maximum of 28 days; the monitoring recording is automatically deleted.

Guests, by making a reservation at Leśne Wzgórze, commit to comply with the provisions of the Terms and Conditions. The Terms and Conditions are valid from January 1, 2024.
